Els contractes d&#8217;arrendament d&#8217;habitatge coneguts col\u00b7loquialment com de renda antiga representen un ecosistema normatiu propi, regit majorit\u00e0riament per la Llei d&#8217;Arrendaments Urbans de 1964. Aquests acords es caracteritzen per una protecci\u00f3 extrema a l&#8217;arrendatari, la qual cosa ha generat un escenari de conviv\u00e8ncia t\u00e8cnica entre legislacions d&#8217;\u00e8poques radicalment distintes, afectant de manera directa a la gesti\u00f3 patrimonial de milers d&#8217;immobles en els centres urbans.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bd37a12 elementor-widget elementor-widget-text-editor\" data-id=\"bd37a12\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h2>El pilar de la pr\u00f2rroga for\u00e7osa i la seva naturalesa jur\u00eddica<\/h2>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-858f46e elementor-widget elementor-widget-text-editor\" data-id=\"858f46e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>L&#8217;element definitori d&#8217;aquests contractes \u00e9s el principi de pr\u00f2rroga for\u00e7osa per a l&#8217;arrendador i volunt\u00e0ria per a l&#8217;arrendatari. Sota l&#8217;empara de la legislaci\u00f3 de 1964, una vegada finalitzat el termini pactat originalment, el contracte es prorroga indefinidament a voluntat de l&#8217;inquil\u00ed. Aquesta figura legal converteix el dret d&#8217;\u00fas en una cosa pr\u00e0cticament vital\u00edcia, limitant la capacitat del propietari per a recuperar la possessi\u00f3 de l&#8217;immoble o per a actualitzar la renda conforme a les fluctuacions del mercat lliure.<\/p>\n<p>La renda, en aquests sup\u00f2sits, sol mantenir-se en nivells nominals molt allunyats de la realitat econ\u00f2mica contempor\u00e0nia. Encara que s&#8217;han introdu\u00eft mecanismes d&#8217;actualitzaci\u00f3 a trav\u00e9s de disposicions transit\u00f2ries en lleis posteriors, com la de 1994, els increments solen ser insuficients per a cobrir els costos de manteniment, impostos i vesses dels edificis. Aix\u00f2 situa al contracte de renda antiga en una posici\u00f3 d&#8217;excepcionalitat dins del tr\u00e0fic jur\u00eddic privat, on l&#8217;equilibri de prestacions entre les parts es veu despla\u00e7at per una funci\u00f3 social de l&#8217;habitatge imposat pel legislador de l&#8217;\u00e8poca.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f148546 elementor-widget elementor-widget-text-editor\" data-id=\"f148546\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h2>La successi\u00f3 del dret: el r\u00e8gim de subrogacions<\/h2>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d739db1 elementor-widget elementor-widget-text-editor\" data-id=\"d739db1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>La continu\u00eftat d&#8217;aquests contractes no es limita necess\u00e0riament a la vida del titular original. La normativa de 1964 permetia un sistema de subrogacions molt ampli que ha estat el principal motiu de la perviv\u00e8ncia d&#8217;aquests lloguers durant d\u00e8cades. Originalment, despr\u00e9s de la defunci\u00f3 del titular, el c\u00f2njuge, els fills o fins i tot els ascendents podien heretar la posici\u00f3 contractual sota les mateixes condicions de renda minsa. Aquesta transmissi\u00f3 del dret d&#8217;arrendament permetia que un habitatge romangu\u00e9s sota el mateix r\u00e8gim contractual al llarg de diverses generacions.<\/p>\n<p>Amb l&#8217;entrada en vigor de la Llei d&#8217;Arrendaments Urbans de 1994, es van establir l\u00edmits temporals a aquest dret de subrogaci\u00f3 per a intentar convergir progressivament cap al mercat lliure. En l&#8217;actualitat, les subrogacions depenen de la data en qu\u00e8 es va signar el contracte original i de qui sigui el titular actual. En termes generals, per als contractes subscrits abans de 1985, el dret de subrogaci\u00f3 del c\u00f2njuge es mant\u00e9 fins a la seva defunci\u00f3, mentre que per als fills la llei imposa restriccions temporals que solen limitar el dret a dos anys o fins que el subrogat compleixi els vint-i-cinc anys, excepte en casos de discapacitat superior al seixanta-cinc per cent, on es permet la durada vital\u00edcia.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5fc6690 elementor-widget elementor-widget-text-editor\" data-id=\"5fc6690\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h2>Les causes legals de denegaci\u00f3 de la pr\u00f2rroga<\/h2>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f45072a elementor-widget elementor-widget-text-editor\" data-id=\"f45072a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Malgrat la protecci\u00f3 gaireb\u00e9 absoluta de la qual gaudeix l&#8217;inquil\u00ed, la Llei d&#8217;Arrendaments Urbans preveu sup\u00f2sits espec\u00edfics en els quals el propietari pot resoldre el contracte i recuperar l&#8217;habitatge. Una de les causes principals \u00e9s la necessitat de l&#8217;habitatge per a si mateix o per als seus ascendents o descendents. Perqu\u00e8 aquesta causa sigui efectiva, l&#8217;arrendador ha d&#8217;acreditar de manera fefaent que existeix una necessitat real d&#8217;ocupaci\u00f3 i complir amb els terminis de preav\u00eds i els requisits d&#8217;ocupaci\u00f3 efectiva posterior que marca la normativa per a evitar fraus de llei.<\/p>\n<p>Una altra causa de resoluci\u00f3 \u00e9s la falta d&#8217;ocupaci\u00f3 de l&#8217;habitatge. L&#8217;esperit de la llei de 1964 era protegir la necessitat d&#8217;habitaci\u00f3, per la qual cosa si l&#8217;immoble roman desocupat durant m\u00e9s de sis mesos en el curs d&#8217;un any sense una causa justificada, el contracte pot ser extingit. De la mateixa manera, l&#8217;impagament de la renda o de les quantitats assimilades, com la repercussi\u00f3 d&#8217;obres o el cost de subministraments i serveis quan aix\u00ed s&#8217;hagi pactat o establert per llei, faculta al propietari per a instar el desnonament. La realitzaci\u00f3 d&#8217;obres inconsultas que modifiquin la configuraci\u00f3 de l&#8217;habitatge o que causin danys dolosos tamb\u00e9 constitueix un motiu de resoluci\u00f3 contractual que la jurisprud\u00e8ncia ha validat de manera reiterada.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9d0ad80 elementor-widget elementor-widget-text-editor\" data-id=\"9d0ad80\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h2>L&#8217;impacte de les obres de conservaci\u00f3 i la ru\u00efna<\/h2>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f2e8b35 elementor-widget elementor-widget-text-editor\" data-id=\"f2e8b35\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>El manteniment dels edificis amb contractes de renda antiga suposa un desafiament t\u00e8cnic i econ\u00f2mic. El propietari est\u00e0 obligat legalment a realitzar les reparacions necess\u00e0ries per a conservar l&#8217;habitatge en condicions d&#8217;habitabilitat. No obstant aix\u00f2, la llei permet repercutir una part del cost d&#8217;aquestes obres a l&#8217;inquil\u00ed mitjan\u00e7ant un increment percentual de la renda anual, seguint els c\u00e0lculs establerts en les disposicions transit\u00f2ries de la llei de 1994.<\/p>\n<p>En situacions extremes on el cost de la reparaci\u00f3 necess\u00e0ria per a mantenir l&#8217;edifici supera el cinquanta per cent del valor de l&#8217;immoble (excloent el valor del s\u00f2l), es pot declarar l&#8217;estat de ru\u00efna. La declaraci\u00f3 administrativa de ru\u00efna o l&#8217;enderrocament acordat per l&#8217;autoritat competent suposa l&#8217;extinci\u00f3 autom\u00e0tica del contracte d&#8217;arrendament. Aquest \u00e9s un dels pocs escenaris on la relaci\u00f3 contractual finalitza sense que medi\u00ef la voluntat de l&#8217;inquil\u00ed ni la necessitat familiar del propietari, basant-se exclusivament en la inviabilitat t\u00e8cnica i econ\u00f2mica de l&#8217;edificaci\u00f3.<\/p>\n<p>En conclusi\u00f3, el lloguer de renda antiga representa un vestigi legislatiu que requereix una an\u00e0lisi detallada de cada contracte i del seu historial de subrogacions. La coexist\u00e8ncia de la Llei de 1964 amb les reformes de 1994 i posteriors genera un marc d&#8217;actuaci\u00f3 on la validesa dels drets dep\u00e8n d&#8217;una aplicaci\u00f3 t\u00e8cnica rigorosa de la norma, buscant resoldre el conflicte entre el dret de propietat i l&#8217;estabilitat de l&#8217;habitatge.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>\u00c9s possible extingir un lloguer de renda antiga?
