Fins fa poc temps, la resposta legal era un no rotund, fonamentat en el dret de copropietat. No obstant aix\u00f2, despr\u00e9s de l&#8217;actualitzaci\u00f3 de la Llei de Propietat Horitzontal impulsada per la Llei 10\/2022, l&#8217;escenari ha canviat significativament, atorgant a les comunitats eines m\u00e9s contundents per a combatre l&#8217;impagament i protegir els interessos dels ve\u00efns complidors.<\/p>\n<p>Actualment, la llei permet que la Junta de Propietaris acordi mesures dissuasives contra els deutors, per\u00f2 \u00e9s fonamental tra\u00e7ar una l\u00ednia clara entre el que es considera un servei essencial i el que no. La normativa vigent \u00e9s clara en permetre la privaci\u00f3 de l&#8217;\u00fas d&#8217;instal\u00b7lacions que no siguin imprescindibles per a l&#8217;habitabilitat de l&#8217;habitatge, com poden ser la piscina, el gimn\u00e0s o les pistes de p\u00e0del.<\/p>\n<p>En aquests casos, la comunitat t\u00e9 la potestat legal de restringir l&#8217;acc\u00e9s com a mesura de pressi\u00f3 davant l&#8217;incompliment de les obligacions econ\u00f2miques, sempre que se segueixin els llits reglamentaris establerts.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3a8c75f elementor-widget elementor-widget-heading\" data-id=\"3a8c75f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">El conflicte legal de l'ascensor i els serveis essencials<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6d827c5 elementor-widget elementor-widget-text-editor\" data-id=\"6d827c5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>El cas de l&#8217;ascensor \u00e9s molt m\u00e9s complex i se situa en una zona de risc legal que requereix una an\u00e0lisi detallada. Per regla general, l&#8217;ascensor es cataloga com un servei essencial per a l&#8217;habitabilitat i, sobretot, per a l&#8217;accessibilitat universal. Impedir el seu \u00fas, especialment si en l&#8217;habitatge resideixen persones majors, fam\u00edlies amb nens petits o persones amb mobilitat redu\u00efda, podria vulnerar drets fonamentals recollits en la nostra Constituci\u00f3. Per aquest motiu, desaconsellem prohibir el seu \u00fas de forma generalitzada, ja que existeix un risc elevat que un jutge declari l&#8217;acord nul i acabi sancionant a la pr\u00f2pia comunitat, agreujant el problema econ\u00f2mic original.<\/p>\n<p>Malgrat aquesta limitaci\u00f3 amb l&#8217;ascensor, la llei actual ofereix altres alternatives molt eficaces que podem implementar des de l&#8217;administraci\u00f3. Per exemple, \u00e9s perfectament legal establir interessos de demora que siguin superiors a l&#8217;inter\u00e8s legal dels diners per a evitar que el ve\u00ed deutor obtingui un benefici financer a costa de la resta de la finca. Aix\u00ed mateix, el propietari mor\u00f3s perd autom\u00e0ticament el seu dret a vot en les juntes, la qual cosa li impedeix influir en les decisions futures de la comunitat de ve\u00efns, encara que se li permeti assistir i ser escoltat en les reunions.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-668b90b elementor-widget elementor-widget-heading\" data-id=\"668b90b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\"> Procediments legals per a una sanci\u00f3 v\u00e0lida i efectiva<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a8c4c37 elementor-widget elementor-widget-text-editor\" data-id=\"a8c4c37\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Perqu\u00e8 qualsevol d&#8217;aquestes restriccions o mesures dissuasives tingui validesa jur\u00eddica i no sigui f\u00e0cilment impugnable, no n&#8217;hi ha prou amb una decisi\u00f3 unilateral de la presid\u00e8ncia o d&#8217;un grup de ve\u00efns. El proc\u00e9s requereix obligat\u00f2riament que la mesura s&#8217;aprovi per majoria en una Junta de Propietaris degudament convocada, havent incl\u00f2s aquest punt espec\u00edfic en l&#8217;ordre del dia. A m\u00e9s, \u00e9s important recalcar que aquestes sancions no tenen car\u00e0cter retroactiu, cosa que significa que nom\u00e9s es poden aplicar per deutes generats despr\u00e9s de l&#8217;aprovaci\u00f3 de l&#8217;acord, sent altament recomanable reflectir aquestes normes en el Reglament de R\u00e8gim Interior.<\/p>\n<p>En conclusi\u00f3, encara que el marc legal \u00e9s avui molt m\u00e9s estricte amb els impagaments, l&#8217;ascensor continua sent un element protegit que requereix un maneig expert i prudent. La via m\u00e9s segura per a resoldre aquests conflictes continua sent la reclamaci\u00f3 judicial mitjan\u00e7ant el proc\u00e9s monitori, combinada amb mesures de pressi\u00f3 en serveis secundaris d&#8217;oci.
