Aquestes associacions s&#8217;encarreguen de gestionar els assumptes comuns de l&#8217;immoble, des del manteniment de les zones compartides fins a la presa de decisions importants que afecten a tots els residents. No obstant aix\u00f2, a vegades, pot sorgir la necessitat d&#8217;impugnar una acta d&#8217;una junta de propietaris si es considera que no s&#8217;han respectat els drets o procediments establerts. En aquest article, <b>explorarem els passos a seguir per a impugnar una acta de comunitat de propietaris a Barcelona, tenint en compte la legislaci\u00f3 vigent a Catalunya.<\/b><\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-dc28909 elementor-widget elementor-widget-heading\" data-id=\"dc28909\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Motius per a impugnar una acta<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b2b53fb elementor-widget elementor-widget-text-editor\" data-id=\"b2b53fb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Existeixen diverses raons per les quals un propietari pot considerar impugnar una acta de la junta de la comunitat. Si no s'aconsegueix aquest qu\u00f2rum, els acords podrien ser impugnables.<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element decisions que vulneren els drets d'algun dels propietaris, com la imposici\u00f3 de sancions injustificades o l'aprovaci\u00f3 d'obres que afecten la propietat privativa d'un resident sense el seu consentiment, aix\u00f2 pot ser motiu d'impugnaci\u00f3.<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ad0b114 documentaci\u00f3<\/b>: Si no s'ha facilitat als propietaris la documentaci\u00f3 necess\u00e0ria per a la presa de decisions, com a pressupostos, informes t\u00e8cnics o comptes, aix\u00f2 pot ser un motiu per a impugnar l'acta.<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b9d5ac3 elementor-widget elementor-widget-heading\" data-id=\"b9d5ac3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\"> Termini per a impugnar una acta<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d9fdf30 elementor-widget elementor-widget-text-editor\" data-id=\"d9fdf30\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Segons la Llei de Propietat Horitzontal de Catalunya, el termini per a impugnar una acta de la junta de propietaris \u00e9s de 30 dies naturals, comptats a partir de l&#8217;endem\u00e0 de la data de celebraci\u00f3 de la junta. \u00c9s important tenir en compte que aquest termini \u00e9s peremptori, \u00e9s a dir, que una vegada transcorregut, no es podr\u00e0 impugnar l&#8217;acta.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a198498 elementor-widget elementor-widget-heading\" data-id=\"a198498\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\"> Procediment per a impugnar una acta<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2588152 elementor-widget elementor-widget-text-editor\" data-id=\"2588152\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Per a impugnar una acta de la junta de propietaris, s&#8217;ha de seguir el seg\u00fcent procediment:<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-177f01a president<\/b> de la comunitat i a l'administrador de finques la intenci\u00f3 d'impugnar l'acta, indicant els motius i sol\u00b7licitant que es convoqui una nova junta per a esmenar els defectes.<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5983721 elementor-icon-list--layout-traditional sol\u00b7licitud<\/b> o si els defectes no s'esmenen en la nova junta, <b>s'ha de presentar una demanda<\/b> davant el jutjat de primera inst\u00e0ncia corresponent al domicili de la comunitat de propietaris.<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-99d2f94 elementor-icon-list--layout-traditional d'exposar els fets i els fonaments jur\u00eddics<\/b> que justifiquen la impugnaci\u00f3, aix\u00ed com sol\u00b7licitar la suspensi\u00f3 cautelar dels acords impugnats.<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-76aa6e2 elementor-icon-list--layout-traditional les parts a una audi\u00e8ncia pr\u00e8via<\/b>, en la qual s'intentar\u00e0 arribar a un acord. Si no \u00e9s possible, s'obrir\u00e0 un per\u00edode de prova i se celebrar\u00e0 el judici.<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4e71c1f elementor-icon-list--layout-traditional elementor-list-item-link-full_width elementor-widget elementor-widget-icon-list\" data-id=\"4e71c1f\" impugnaci\u00f3, <b>els acords impugnats quedaran sense efecte<\/b> i s'hauran d'adoptar nous acords en una junta extraordin\u00e0ria.<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1a0156d elementor-widget elementor-size-default\"> Conseq\u00fc\u00e8ncies d'impugnar una acta<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cf003f0 elementor-widget
