De manera que <strong>per saber si pots llogar, haur\u00e0s d&#8217;acudir a aquests estatuts.<\/strong> Si aquests no recullen res sobre aquest tema, pot traslladar-se l&#8217;assumpte a una junta i sotmetre&#8217;l a votaci\u00f3.<\/p><p align=\"justify\">Fins fa poc era necessari el vot un\u00e0nim del total dels propietaris per a adoptar aquest tipus d&#8217;acords. No obstant aix\u00f2, amb el Reial decret 7\/2019, d&#8217;1 de mar\u00e7, per poder limitar o condicionar l&#8217;exercici de l&#8217;activitat de lloguer tur\u00edstic d&#8217;un habitatge n&#8217;hi ha prou amb una majoria de tres cinquenes parts dels comuns. \u00c9s a dir, que <b>la comunitat de propietaris pot prohibir el lloguer vacacional. Aprofundim m\u00e9s en aquest assump<\/b>te.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-2fbf0b4 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"2fbf0b4\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-685dab6\" data-id=\"685dab6\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-088185f elementor-widget elementor-widget-heading\" data-id=\"088185f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Qu\u00e8 diu la llei sobre la prohibici\u00f3 de lloguer tur\u00edstic?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-be94fc5 elementor-widget elementor-widget-text-editor\" data-id=\"be94fc5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p align=\"justify\">El Reial decret llei 7\/2019 d&#8217;1 de mar\u00e7 de mesures urgents en mat\u00e8ria d&#8217;habitatge i lloguer, concedeix a les Comunitats de Propietaris la possibilitat d&#8217;acordar la prohibici\u00f3 del lloguer tur\u00edstic per la Comunitat de propietaris. L&#8217;article 17.12\u00a0LPH\u00a0estableix el seg\u00fcent:<\/p><p align=\"justify\">\u00ab<i>\u00abEls acords de la Junta de propietaris se subjectaran a les seg\u00fcents regles:<\/i><\/p><p align=\"justify\"><i>12. L&#8217;acord pel qual es limiti o condicioni l&#8217;exercici de l&#8217;activitat a qu\u00e8 es refereix la lletra e) de l&#8217;article 5 de la Llei 29\/1994, de 24 de novembre, d&#8217;Arrendaments Urbans, en els termes establerts en la normativa sectorial tur\u00edstica, suposi o no modificaci\u00f3 del t\u00edtol constitutiu o dels estatuts, requerir\u00e0 el vot favorable de les tres cinquenes parts del total dels propietaris que, al seu torn, representin les tres cinquenes parts de les quotes de participaci\u00f3.<\/i><\/p><p align=\"justify\"><i>Aix\u00ed mateix, aquesta mateixa majoria es requerir\u00e0 per a l&#8217;acord pel qual s&#8217;estableixin quotes especials de despeses o un increment en la participaci\u00f3 de les despeses comunes de l&#8217;habitatge on es realitzi aquesta activitat, sempre que aquestes modificacions no suposin un increment superior al 20%. Aquests acords no tindran efectes retroactius\u00bb.<\/i><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-c8bf69d elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"c8bf69d\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Com \u00e9s el proc\u00e9s per prohibir llogar un pis tur\u00edstic?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-62de8f1 elementor-widget elementor-widget-text-editor\" data-id=\"62de8f1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p align=\"justify\">Si en el t\u00edtol constitutiu o en els estatuts figura una limitaci\u00f3 de car\u00e0cter general sobre el dest\u00ed dels habitatges, o no existeix cap limitaci\u00f3, ser\u00e0 necessari que la Junta de propietaris de la Comunitat adopti un acord establint la prohibici\u00f3 del lloguer tur\u00edstic en l&#8217;immoble.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-28176d3 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"28176d3\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<ul><li><p align=\"justify\">Per a limitar o condicions el lloguer tur\u00edstic la Comunitat de propietaris haur\u00e0 d&#8217;<strong>aprovar un acord en el qual bastar\u00e0 el vot dels 3\/5 parts del total dels propietaris<\/strong> que representin les tres cinquenes parts de les quotes de participaci\u00f3.<\/p><\/li><li><p align=\"justify\">Existeixi o no existeixi limitaci\u00f3 per la Comunitat, per\u00a0 poder utilitzar l&#8217;habitatge com a lloguer tur\u00edstic s&#8217;haur\u00e0 de comptar amb l<strong>&#8216;autoritzaci\u00f3 de l&#8217;administraci\u00f3 auton\u00f2mica<\/strong> corresponent.<\/p><\/li><li><p align=\"justify\">L&#8217;acord nom\u00e9s vincularia als propietaris que vulguin destinar el seu habitatge a aquesta activitat a partir del moment en qu\u00e8 s&#8217;adopti, ja que <strong>no t\u00e9 car\u00e0cter retroactiu.<\/strong><\/p><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-754fab2\" data-id=\"754fab2\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-bc03e0d elementor-widget elementor-widget-image\" data-id=\"bc03e0d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<ul>\r\n \t<li>\r\n<p align=\"justify\">La Comunitat ha de convocar una Junta de Propietaris incloent en l&#8217;ordre del dia expressament l&#8217;acord que \u00e9s el que es votar\u00e0, com es pret\u00e9n limitar o condicionar el lloguer vacacional o lloguer tur\u00edstic.<\/p>\r\n<\/li>\r\n \t<li>\r\n<p align=\"justify\">Si l&#8217;acord \u00e9s finalment aprovat amb la majoria que hem ressenyat anteriorment (tres cinquenes parts del total de propietaris i quotes de participaci\u00f3) haur\u00e0 d&#8217;expedir-se un certificat d&#8217;aquest acord per a procedir a la seva inscripci\u00f3 en el Registre de la Propietat amb l&#8217;objectiu que els futurs adquirents de pisos de l&#8217;edifici coneguin la limitaci\u00f3 existent i quedin vinculat a aquesta.<\/p>\r\n<\/li>\r\n<\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-d8a96de elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"d8a96de\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column pis tur\u00edstic?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e9e0344 elementor-widget elementor-widget-text-editor\" data-id=\"e9e0344\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p align=\"justify\">El nou apartat 12 de l&#8217;art. 17 de la Llei de Propietat Horitzontal <strong>permet agreujar les quotes especials de despeses<\/strong> o incrementar la participaci\u00f3 en les despeses comunes de l&#8217;habitatge on es realitzi l&#8217;activitat tur\u00edstica, <strong>sempre que les modificacions no suposin un increment superior al 20%.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-4021fdc elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"4021fdc\" data-element_type=\"section\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Qu\u00e8 passa si es lloga un pis tur\u00edstic estant prohibit per la comunitat?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9241af9 elementor-widget elementor-widget-text-editor\" data-id=\"9241af9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p align=\"justify\">Si la Comunitat t\u00e9 prohibit l&#8217;\u00fas del lloguer tur\u00edstic en l&#8217;edifici, per\u00f2 un propietari destina el seu habitatge a tal fi, la Comunitat pot exercitar l&#8217;acci\u00f3 de cessaci\u00f3 d&#8217;aquesta activitat a l&#8217;empara del que es disposa en l&#8217;article 7.2 de la Llei de Propietat Horitzontal: <em>\u00abSi l&#8217;infractor persist\u00eds en la seva conducta el President, pr\u00e8via autoritzaci\u00f3 de la Junta de propietaris, degudament convocada a aquest efecte, podr\u00e0 entaular contra ell acci\u00f3 de cessaci\u00f3 que, en el no previst expressament per aquest article, se substanciar\u00e0 a trav\u00e9s del judici ordinari\u00bb<\/em>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-f2d76dc elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"f2d76dc\" data-element_type=\"section\"
